TERMS AND CONDITIONS OF SALE

 

1. About Us and How to Contact Us

These are the terms and conditions on which we supply products to you through our website at www.artchinois.com.

We are LEKA Global Ltd, a company registered in England and Wales under company number 16824352. Our registered office is at 3rd Floor, 86-90 Paul Street, London, England, EC2A 4NE. We trade under the brand name Art Chinois.

2. These Terms

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

By placing an order, you agree to be bound by these terms. If you do not agree to these terms, you must not order any products from us.

We may amend these terms from time to time. Every time you wish to order products, please check these terms to ensure you understand the terms that apply at that time.


3. Our Products

Our products are hand-painted porcelain art tiles and related items, crafted using traditional techniques. Every Art Chinois piece is meticulously inspected, hand-packed and dispatched from our studio in London, United Kingdom.

Handcrafted Variations

Our products are handcrafted using traditional Intangible Cultural Heritage techniques. As a result, minor variations in colour, texture, pattern and dimensions are an inherent and intentional characteristic of each piece and are not defects. In particular, some of our products feature an Ice-Crackle glaze. This effect is the result of complex temperature fluctuations during the kiln-firing process and is a standard characteristic of underglaze porcelain. The presence or absence of crackle patterns depends on the glaze composition and is an intentional artistic outcome.

Every item is rigorously inspected to ensure structural integrity and aesthetic excellence. Ice-crackle finish and other natural variations are not quality issues. We do not accept returns or offer refunds based on these natural variations alone. We encourage customers to review product photographs carefully before ordering. If you require a smooth finish without crackle, please contact us at hello@artchinois.com before placing your order.

A product’s true colour may not exactly match that shown on your device or in our marketing. Because our products are handmade, sizes, weights and dimensions indicated on our website may vary slightly.


4. Placing an Order and Acceptance

When you place an order through our website, your order constitutes an offer to purchase the products. We will send you an order confirmation by email, but please note that this does not mean your order has been accepted.

Our acceptance of your order will take place when we dispatch the product to you and confirm dispatch by email, at which point a contract will come into existence between you and us.

We may refuse to accept your order if, for example, a product is unexpectedly out of stock, we are unable to verify your identity or age, or the product was mispriced by us. When this happens, we will let you know as soon as possible and refund any sums you have paid.


5. Price and Payment

The price of the products will be the price indicated on the order pages when you place your order. We take all reasonable care to ensure that prices are correct. However, if we discover an error in the price of a product you have ordered, we will contact you to inform you of the error and give you the option of continuing with the order at the correct price or cancelling the order.

All prices are inclusive of VAT (where applicable) at the rate in force at the time of your order. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid in full before the change takes effect.

Payment is processed through secure third-party payment gateways (such as Stripe or PayPal). We accept payment by the methods displayed on our website at the point of checkout.


6. Delivery

We deliver to the following zones with the following estimated timescales:

 United Kingdom: 2–4 business days (Standard) / 1–2 business days (Express).

 European Union: 5–10 business days.

 North America (USA and Canada): 7–14 business days.

 Rest of the World: 10–21 business days.

These are estimated delivery times and are not guaranteed. Delivery of an order shall be completed when we deliver the products to the address you gave us.

If our supply of your product is delayed by an event outside our control, we will contact you as soon as possible to let you know and will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event. If there is a risk of substantial delay, you may contact us to end the contract and receive a refund for any products you have paid for but not received.


7. Customs, Duties and Taxes

As we ship from the United Kingdom, international orders (including those to the European Union and North America) may be subject to import duties, taxes and customs clearance charges once the shipment reaches the destination country. These charges are determined by the customs authority in the destination country.

All such import duties, taxes and charges are the sole responsibility of the recipient. We have no control over these charges, cannot predict their amount, and are not responsible for any delays caused by the customs process. We strongly recommend that you contact your local customs office for further information before placing an order, particularly for high-value items.

Refusal to pay applicable duties or taxes resulting in the return of a shipment to us will mean that any return shipping costs and duties incurred by us will be deducted from your refund.


8. Fragile Item Guarantee

Porcelain and fine bamboo are delicate by nature. We use specialised reinforced packaging to protect your items during transit. However, if your order arrives damaged, the following conditions apply:

  • Notification: You must contact us at hello@artchinois.com within 24 hours of delivery.
  • Photographic evidence: You must provide clear photographs of both the damaged item and the outer packaging.
  • Resolution: Once we have verified the damage, we will arrange a priority replacement at no additional cost to you.

We reserve the right to decline a damage claim where the above conditions are not met. This guarantee is in addition to, and does not affect, your legal rights (see section 11 below).


9. 30-Day Art Guarantee and Returns

We want you to be delighted with your Art Chinois acquisition. If you are not completely satisfied, we accept returns within 30 days of delivery, subject to the following conditions:

  • Items must be in their original, unused condition and returned in the original packaging.
  • To initiate a return, please email us at hello@artchinois.com.
  • Customers are responsible for return shipping costs unless the item is faulty or damaged upon arrival.

This 30-Day Art Guarantee is offered in addition to your legal rights. It does not apply to returns based on natural handcrafted variations, including the Ice-Crackle glaze, as described in section 3 above.

 

Your Legal Right to Change Your Mind

If you purchase products through our website, you have a legal right to change your mind about your purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel your order within 14 days of receiving the products, without giving any reason.

To exercise your right to cancel, you must inform us by a clear statement (for example, by email to hello@artchinois.com). You must then return the product to us within 14 days of notifying us. You will be responsible for the cost of returning the product to us.

We will reimburse all payments received from you, including the cost of standard delivery (but not any extra costs for express or timed delivery), without undue delay and in any event no later than 14 days from the day on which we receive the returned products or you supply evidence of having sent them back to us, whichever is the earliest.

We may reduce your refund to reflect any reduction in the value of the products if this has been caused by your handling them in a way which would not be permitted in a shop.

 

When You Cannot Change Your Mind

You cannot change your mind about an order for products sealed for health protection or hygiene purposes once these have been unsealed after you receive them, or for goods that are made to your specifications or are clearly personalised.


10. Refunds

If you are entitled to a refund, we will refund you by the method you used for payment. We do not charge a fee for the refund. We will process the refund due to you as soon as possible and, in any case, within the timescales required by law.


11. Your Rights If There Is Something Wrong with Your Product

We are under a legal duty to supply products that are in conformity with the contract. Nothing in these terms will affect your legal rights under the Consumer Rights Act 2015. For detailed information, please visit the Citizens Advice website at www.citizensadvice.org.uk.

If you think there is something wrong with your product, please contact us at hello@artchinois.com. Please note that natural handcrafted variations described in section 3, including the Ice-Crackle glaze, are intentional characteristics and not faults.


12. Changes to Products and These Terms

We may change a product to reflect changes in relevant laws and regulatory requirements, or to make minor technical adjustments and improvements that do not materially affect your use of the product.

We may amend these terms from time to time. The updated terms will apply to orders placed after the date of the update.


13. Our Liability

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the products.

We are not responsible for losses you suffer that are not a foreseeable consequence of our breaking the contract, that are caused by a delaying event outside our control (provided we have taken reasonable steps to notify you), or that you could have avoided by taking reasonable action.

We are not liable for any business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.


14. How We Use Your Personal Data

We will use the personal data you provide to us in accordance with our Privacy Policy, which can be found on our website.


15. Disputes

If you have any complaint or wish to raise a dispute, please contact us at hello@artchinois.com and we will try to resolve the issue.

Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not satisfied with the outcome of our complaints process, you may wish to use an alternative dispute resolution service.


16. Other Important Terms

We may transfer our rights and obligations under these terms to another organisation. We will contact you to let you know if we plan to do this.

You may only transfer your rights or obligations under these terms to another person if we agree to this in writing.

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

If a court finds part of this contract illegal, the rest will continue in force.

Even if we delay in enforcing this contract, we can still enforce it later.


17. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales. You can bring legal proceedings in respect of the products in the English and Welsh courts. If you live in Scotland, you can bring legal proceedings in either the Scottish or English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or English courts.
